At present, the technical appraisal of medical accidents has undergone significant reforms with the promulgation of the "Regulations", which has made the organizational structure, personnel qualification selection, and appraisal procedures open and transparent, reflecting a democratic style and having a positive significance in ensuring the fairness of appraisal conclusions. However, the current appraisal system still has certain shortcomings, especially in the process of aligning with the litigation system.
Overview of Technical Appraisal for Medical Accidents
With the continuous deepening of China's reform and opening up, the national medical system has been further reformed, and social welfare medical units have gradually transformed into for-profit economic entities. In addition, with the continuous improvement of China's legal system, the overall quality and legal awareness of citizens have been enhanced, and people's awareness of rights protection has been continuously strengthened. Medical disputes have been increasing, and the trend is on the rise. At the same time, due to the misleading public opinion such as news media, the conflict between doctors and patients has become increasingly acute and complex, and has become a hot and difficult topic in today's society. The original "Measures for Handling Medical Accidents" (hereinafter referred to as the "Measures") are no longer suitable for the current needs of dispute resolution, and in some places have even become a piece of paper. In order to properly handle and resolve medical disputes, the State Council issued a new "Regulations on Handling Medical Accidents" (hereinafter referred to as the "Regulations") on [date] in 2002, and the Ministry of Health has formulated corresponding supporting regulations based on the regulations.
